The use of the term 'The Trail Co.Club' refers to the service whereby a customer pays an annual fee to be included in special discounts, events and training sessions. Should the name of the club change, these Terms and Conditions are still applicable. 'The Club' will be used throughout these terms and conditions to refer to 'The Trail Co. Club'.
Item 1.2 and Section 4 apply to all individuals attending Club runs, whether they are Members, Casual Runners or attending a free trial session.
By purchasing membership to the club, you hereby understand and agree to the following:
1.1 You are required to inform The Trail Co. of any change in your details at the earliest opportunity.
1.2 The Trail Co. reserves the right to use all images and/or footage captured during activities associated with The Club.
1.3 By signing up to The Club, you will be subscribed to our newsletter. Your details will not be given out to third party or sold. This newsletter is the main method which will be used to keep you informed about specials and events. Should you choose to unsubscribe from the newsletter, you may do so at any time but you understand that you may miss out on some benefits of the club if you are unaware of the latest offerings.
1.4 The Trail Co. does not accept responsibility for any lost opportunities to access benefits that may arise from missed emails, spam filters or other unforeseeable circumstances that may cause delays or block you from receiving our email notifications. Every effort will be made on our behalf to ensure the notifications are regular and timely.
2. Special Pricing
2.1 Members will be entitled to exclusive discounts throughout the year. These will be communicated through regular newsletters and on www.thetrail.co
2.2 Unless otherwise stated, members discounts will not be applicable with other offers, only apply while stocks last and are only available to current, paid, registered members of The Club.
2.3 Our normal returns policy will apply to items purchased using the Members discount, if they would otherwise have been available to the general public for full price. Items that are on sale or clearance to the general public may not be eligible for change of mind returns.
3. VIP Access
3.1 As a member of The Club, you will receive email notifications when there are earlybird, discounted or exclusive tickets available to you.
3.2 The Trail Co. cannot guarantee you a place at these events if they sell out before you register. For example, if you miss the earlybird window and ticket sales open to the general public, you may miss out on a place.
4. Run Training Sessions
4.1 You are participating in activities associated with The Trail Co. of your own volition. You understand that fitness training and exercise require physical exertion, which may be strenuous and may cause injury, and are fully aware of and accept the risks and hazards involved.
4.2 You must be over 16 years of age to participate in training sessions. Participants under this age will be considered on a case by case basis in consultation with the participant’s parent or guardian.
4.3 It is your responsibility to consult with a physician prior to participating in activities associated with The Trail Co. You represent and warrant that you are physically fit and have no medical condition which would compromise you participating safely in activities with The Trail Co. You agree to immediately inform The Trail Co. and cease participation if this changes.
4.4 It is your responsibility to act with due care for your own safety and for the safety of other participants at all times.
4.5 You declare that you are in a fit state of health to participate in activities associated with The Club. Prior to participating in any event or training scenario, you hereby release The Trail Co., its officers, employees, agents and representatives from any responsibility for loss, damage, personal injury and liability of any kind.
4.6 The Trail Co. will host at least 52 sessions over each calendar year. All efforts will be made to provide at least one session each week however this will be at the discretion of The Trail Co. and there may be times during the year where there is no run scheduled during a particular week.
5. Free Club Shirt
5.1 Members of the club are entitled to one free Running Shirt or Singlet per membership year. All efforts will be made to provide you with your first choice in size or design however there may be times when your preferred option is sold out. In this instance, members are entitled to the closest available alternative or may wait until a new shirt or singlet is available.
5.2 Members who choose a suitable alternative are not entitled to a second free shirt in the same membership year if their first choice later becomes available.
5.3 There may be instances where a new design is available in some sizes and/or styles while the older design still exists in other sizes and styles. In this instance, the new design will not become available until the orginal one is sold out. The exception to this rule is for renewing members, who will be given the choice of the new design if it is available at the time of their renewal.
The term ‘The Trail Co. Pty Ltd’ or ‘us’ or ‘we’ refers to the owner of the website whose registered office is . Our ABN is 90609730985. The term ‘you’ refers to the user or viewer of our website.
